Article 1 - Obligations of the driving school

1.1The driving lessons are provided by an instructor who meets the requirements of the Motor Vehicle Driving Training Act (WRM) and has a valid WRM competence pass.

1.2The driving school strives to ensure that the student receives as much lessons as possible from the same instructor during the course, to guarantee progress and continuity.

1.3The instructor regularly informs the student about his or her progress, and at least once every five practical lessons. It also indicates how the progress relates to the exam requirements.

1.4The full agreed class time is used for giving practical lessons, unless there are unforeseen circumstances or another reasonable reason.

1.5Within two weeks after payment of the exam fee, the driving school will reserve the practical exam or the test at the competent examination office (such as the CBR).

1.6In principle, the student takes the practical exam in the lesson car that has been taught. In exceptional cases, such as force majeure, an equivalent lesson car can be used.

1.7If a lesson cannot take place due to force majeure (such as illness of the instructor, traffic nuisance or extreme weather conditions), the driving school informs the student as soon as possible and a new appointment is scheduled. In that case, no refund is due.

1.8The driving school has sound business and liability insurance.

1.9The driving school informs the student about medical conditions or circumstances that may affect the fitness to drive or the right to issue a driver’s license.

1.10The driving school informs the student that his or her residence status can influence obtaining a driver’s license in the Netherlands.

1.11The student is informed that he or she is obliged to report when the authority to drive a motor vehicle has been denied him or her.

Article 2 - Obligations of the student

2.1The student must be at least 16.5 years old to be allowed to take practical lessons. The student must have a valid proof of identity with him during each driving lesson.

2.2The student is obliged to be ready for the lesson at the agreed time and at the agreed location. If the student is late, the instructor will wait a maximum of 15 minutes. If the student is not present within this time, the lesson will be canceled and will be charged in full.

2.3Driving lessons can be canceled or moved free of charge up to 48 hours in advance. If canceled within 48 hours, the driving school reserves the right to charge the full lesson price in connection with the reserved time. Are there demonstrable force majeure or special circumstances, at the discretion of the driving school.

2.4The student is obliged to inform the driving school completely and truthfully prior to the lessons about:
• medical or mental disorders that can affect the ability to drive;
• use of medicines that influence the ability to drive (as stated on the package leaflet);
• Alcohol or drug use;
• A possible denial of driving or suspension of the authority to drive a motor vehicle.

2.5If it appears that the student has withheld or incorrectly provided information as referred to in Article 2.4, the driving school has the right to terminate the lesson agreement immediately without a refund of tuition fees already paid. The driving school can also recover any damage or liability that ensues from the student.

Article 4 - Driving tests

4.1If the student does not appear on time for the exam or misses the exam due to his own actions, the exam will lapse and the costs for a new application are for his own account.

4.2In the event of relocation or cancellation of the exam by the CBR exam office due to (weather) circumstances, the new exam does not have to be paid, but the driving school may charge an extra driving lesson.

Article 5 - Termination of the lesson agreement

5.1The driving school can terminate the lesson agreement when:
• the student has deliberately provided incorrect information (eg medical situation)
